2. What Information Accelrys Collects
Accelrys' web server collects non-personally identifiable information from you during the course of your visit to the Site. Our web server automatically recognizes your IP address, web browser version, the referring page, and the site you came from. Sometimes it is possible to identify your organization or employer from the IP address. We automatically collect this information, and aggregate information on which pages are accessed by visitors. We may also collect information about the content on the Site you access, the platform operating system you use, and the date, time, and duration of your visit to the Site.
This information may be collected through the use of a “cookie.” Cookies are small text files that are stored on your hard drive to store your preferences. Cookies themselves do not contain any personally identifiable information. You can choose to refuse any cookie by following the procedure suggested by your particular web browser. You may delete Accelrys cookies from your computer, but doing so may impair your use of the Site.
Accelrys may also use “web beacons” on the Site from time to time. Web beacons are small pieces of code placed on a web page to track or monitor the behavior and collect data about the visitors viewing a web page. For example, web beacons can be used to count the users who visit a web page or to deliver a cookie to the browser of a visitor viewing that page.
Accelrys may also collect information from you through your voluntary submission. For instance, such information may be submitted through your use of an online form to register with Accelrys to access and use certain portions of the Site, or by sending Accelrys an email to request certain services from Accelrys. You may also give Accelrys personal information when submitting a résumé and/or an employment application. In other cases, such information may be the content or information you post in a web-forum, in a chat room, or through other interactive or “social networking” portions of the Site (collectively referred to herein as the “Interactive Portions” of the Site). The information you voluntarily submit may include information which may be used to personally identify you, such as your name, physical address, telephone number, and e-mail address.
Note that when you come to the Site by clicking on a link in an e-mail received from Accelrys, it may be possible for us to associate that visit with the address to which the e-mail was sent. We occasionally send HTML e-mails to customers and other contacts in order to update them on our products and the activities of our business (for example, our monthly eFlash newsletter). You can also ask not to receive such messages by mailing firstname.lastname@example.org or visiting http://app.accelrys.com/SubscriptionManagement.html. If you do so, the e-mail address from which your request is sent will no longer receive any unsolicited e-mail from Accelrys.
Some of these HTML e-mails use Third Party services that can track your response through the use of custom links within the e-mail and by recording the download of images embedded within the HTML from the Third Party's server. This allows Accelrys to deduce whether you have opened the message and, if you click on a hyperlink in the message to visit the Site, to associate each web page you visit on the Site with the specific e-mail address to which the message was sent.
IMPORTANT: In some instances, the e-mail we send to you may contain personally identifiable information about yourself, or may include a link to access portions of Accelrys’ Site or systems that contain personally identifiable information about yourself. Forwarding these e-mails to Third Parties may permit such Third Parties to have access to personally identifiable information about yourself. You therefore should be very careful about forwarding any emails you receive from Accelrys to any Third Parties.
3. How Accelrys Uses the Information It Collects
Accelrys uses information it collects to, among other things, process your requests and transactions, offer or furnish additional services, personalize the types of information you receive from Accelrys, assess trends in the use of the Site, provide targeted marketing to you and other customers, develop content and functionality that helps serve our users needs, and improve the products and services that Accelrys provides.
Non-Personally Identifiable Information
Accelrys’ use of the non-personally identifiable information it collects through the Site is unrestricted. Accelrys may sell or license non-personally identifiable information or aggregated information (information derived from personally identifiable information, but not containing any personally identifying details) to Third Parties.
In the event Accelrys uses Google Analytics, the information generated by the cookie about your use of the Site (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the Site, compiling reports on website activity for Accelrys and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. Google will not associate your IP address with any other data held by Google.
Personally Identifiable Information
Except as provided below, Accelrys will not use your personally identifiable information in a manner different from that stated at the time of collection (the “Purpose”) without first attempting to notify you via the last e-mail address Accelrys has in its records. Accelrys will only share your personally identifiable information with Third Parties that assist Accelrys in carrying out the Purpose. Such Third Parties shall be required to use your personally identifiable information only to assist in the Purpose and to maintain the confidentiality of your personally identifiable information.
Résumés and other materials submitted by job applicants are used for applicant screening and hiring purposes, and for general human resource related purposes.
If you supply us with your postal address on-line you may receive periodic mailings from us with information on new products and services or upcoming events. If you supply us with your telephone number, we may call you with information regarding new products and services or upcoming events.
If you do not wish to receive such e-mails, postal mailers, or telephone calls, please let us know by sending us an e-mail message.
IMPORTANT: Any information you submit using the Interactive Portions of the Site, even personally identifiable information, may be automatically publicly displayed on the Site. You therefore should be very careful about providing any personally identifiable information about yourself using the Interactive Portions of the Site.
Other Exceptions; Legal Requirements
Accelrys reserves the right at all times to: (a) use disclose any information it reasonably believes necessary to satisfy any law, regulation, government request, court order, subpoena or other legal process; (b) edit or remove any information, in whole or in part, that in Accelrys’ sole discretion is objectionable, disruptive to the Site or in violation of the Terms and Conditions; (c) use and disclose any information when Accelrys believes it is necessary to prevent harm or injury, to prevent fraud, or to protect Accelrys’ legal interests; and (d) use and disclose any information in connection with an investigation of suspected or actual illegal activity.
If you reside in the European Economic Area or Switzerland, you may opt out of some of the disclosures described in this section by contacting us as set forth below.
4. Retention and Integrity of Information
You can request access, modifications to, or removal of the personally identifiable information collected by Accelrys through your use of the Site by contacting Accelrys using the contact point set forth below. To honor your request, Accelrys will need the exact information you want to access, modify, or remove. Accelrys will use reasonable efforts to provide you with access to and to modify or remove such information if requested, provided, however, Accelrys will not be liable to you should it be unable, after such efforts, to identify, modify, or remove such information. Accelrys may also decline requests that are unreasonable, require disproportionate technical effort, or that jeopardize the privacy of others. Due to the dynamic and ever-changing nature of the interactive portions of the Site, you acknowledge and agree it may be impossible for Accelrys to access, modify or remove personally identifiable from these portions of the Site.
Accelrys is committed to protecting the privacy of children. Neither Accelrys nor any of its services are designed or intended to attract children under the age of 13. Accelrys does not collect personally identifiable information from any person that Accelrys knows to be under the age of 13.
Accelrys has put in place reasonably appropriate physical, electronic, and/or procedural safeguards to protect your personally identifiable information. However, even with such measures, no one is able to guarantee that unauthorized Third Parties will not be able to bypass these measures or otherwise capture such information. Accelrys shall not be liable to you for any Third Party’s unauthorized access to or use of your personally identifiable information.
